Terms of Service

Thanks for using Modern Mix! It’s a small, independent project for turning playlists into gifts and sharing the music you love, made by one person. Because I can’t know everyone who uses it, here are the terms that keep things running fairly for everyone.

When these terms say “Modern Mix”, “we”, “us” or “our”, they mean David Ryan, who runs Modern Mix as an individual in Louisiana, USA. “The Service” means the website at modernmix.app and everything on it: the mix pages, the list maker, saved lists, and anything we add later. “You” means anyone who uses the Service, whether you make a mix or list, or just open one someone sent you.

By using the Service, you agree to the latest version of these terms. If we don’t enforce a part of these terms at some point, that doesn’t mean we’ve given up the right to. These terms include a limitation of our liability (see “Liability” below).

Using Modern Mix

1. You must be at least 13 years old to make a list or mix.
2. You must be a person. Making lists with bots or other automated tools isn’t allowed.
3. There are no accounts (yet). When you save a list, you get a private edit link. Anyone with that link can edit or delete your list, so keep it safe. We can’t recover a lost edit link, but if you need a list taken down, contact us and we’ll help.
4. You’re responsible for what you make: the titles, names, notes and dedications in your lists and mixes, and for following these terms and the law.

What you can’t do

When you use Modern Mix, you agree not to:

• Post anything illegal, or use the Service in a way that breaks any law or regulation.
• Harass, threaten, intimidate or bully anyone, or post hateful content that attacks people for who they are.
• Post sexual content involving minors, or any sexual content that isn’t appropriate for a public page.
• Impersonate someone else, or mislead people about who made a list.
• Use lists or mixes for spam, advertising or scams.
• Post other people’s copyrighted work beyond what fair use allows. That includes full song lyrics: quoting a line about why a song matters to you is fine; pasting a whole song isn’t.
• Upload or link to malware, or try to collect information about other people from the Service.
• Get around, disable or interfere with the Service’s security features, rate limits or bot checks.
• Overload, disrupt or scrape the Service.
• Make false reports about other people’s lists.

We may remove anything that breaks these rules, and block anyone who keeps breaking them, without notice.

Your content

1. What you make is yours. We don’t claim ownership of your lists, mixes, notes or dedications.
2. You give us permission to show it. By saving a list or mix, you give us a limited license to store it, display it and share it as part of the Service: as a public page that anyone with its link can see, in story cards and link previews, and in backups. This license ends when you delete it (backups clear within 30 days).
3. Lists are public pages. Anyone with the link can see a saved list, and anyone it’s shared with can share it further. Don’t put anything in a list you wouldn’t want seen publicly.
4. We don’t pre-screen content, but we may remove any content at our discretion, for example when it’s reported and breaks these terms.
5. We never use what you make with AI without asking you first, including training it, and we don’t sell or give it to anyone who would. See the AI Policy.

Music and other services

1. We don’t host music. Songs play through the official players of Spotify, YouTube, Tidal and Apple Music, and links open in those apps. Using them is subject to their own terms and privacy policies.
2. Song details, artwork and previews come from those services (for example Apple Music’s search and previews) and belong to their owners. We show them only to identify the music you picked and link you to it.
3. Modern Mix isn’t affiliated with or endorsed by Spotify, Apple, YouTube, Google or Tidal. Their names and logos are their trademarks.
4. We can’t guarantee those services work. They can change, limit (for example to 30-second previews when you’re not signed in) or stop their players and data at any time, and some songs may be unavailable where you are.

The Service, changes and pricing

1. Modern Mix is free right now. If we add paid features, they’ll come with clear prices and any extra terms before you pay.
2. We may change, pause or stop any part of the Service at any time, with or without notice. We’ll try to give notice before removing anything you’ve made.
3. We may update these terms. When we make a significant change, we’ll update the date at the top. Using the Service after a change means you accept the updated terms.

Privacy

How we handle information is explained in our Privacy policy. In short: cookieless analytics and no selling your data. How we handle AI is in the AI Policy.

Copyright

Making original work is hard, and we respect it. You can’t use Modern Mix to share other people’s copyrighted work beyond the bounds of fair use.

If you own a copyright and believe something on Modern Mix infringes it, email info@modernmix.app with:

• Your name and contact information.
• What copyrighted work you believe is infringed.
• Where it is on Modern Mix (the list or mix link is ideal).
• A statement that you believe in good faith the use isn’t authorized by the copyright owner, its agent or the law, and that you’re the owner or authorized to act for them.

We’ll review it and remove infringing content promptly, usually the same day, and let the person who made it know. If you made something that was removed and believe it was a mistake, email us and we’ll take another look.

Repeat infringers: we’ll remove the content of anyone who repeatedly infringes copyright and block them from using the Service.

Reporting problems

Use “Report this list” at the bottom of any list, or email info@modernmix.app with the link and what’s wrong. We won’t tell the list’s maker who reported it.

Removing content and blocking use

We may remove any list or mix, and refuse the Service to anyone, at any time, for any reason, in particular for breaking these terms. Abuse or threats toward the person who runs Modern Mix will get you blocked immediately.

No guarantees

The Service is provided “as is” and “as available”, at your own risk. We build it with care and test it, but like all software it has bugs, it may be unavailable at times, and it may not meet every need. We don’t promise that it will be error-free or always online, or that your lists will be kept forever. Keep a copy of anything you’d hate to lose.

Liability

To the fullest extent the law allows, Modern Mix and the person who runs it shall not be liable, in law or in equity, to you or to any third party for any direct, indirect, incidental, lost profits, special, consequential, punitive or exemplary damages, including damages for loss of goodwill, use, data or other intangible losses (even if we’ve been told such damages are possible), resulting from: (i) using or being unable to use the Service; (ii) unauthorized access to or changes to your content; (iii) statements or conduct of anyone else on the Service, including content in lists and mixes made by others; (iv) the music services, players or data the Service relies on; or (v) anything else relating to these terms or the Service.

In other words: Modern Mix is a free, small project, offered as is. We do our best to keep it safe and working, and we’re grateful you’re using it.

Governing law

These terms are governed by the laws of the State of Louisiana and the United States, without regard to conflict-of-law rules.
